The bill, which could pass this week, includes the following “ An attorney shall not delegate the practice of law to generative artificial intelligence.”

The term “practice of law” has been fought over for 100+ years. It includes using software to select which form to file (see pages 13-15 of https://cdn.ca9.uscourts.gov/datastore/opinions/2007/02/26/0...).

So what happens if a lawyer asks Harvey/Legora/Claude which form is appropriate given certain facts? They have just delegated the practice of law, and thus broken the law.

Unclear why legal tech / ai native law firms are sleeping on this bill. Particularly for the ai natives, seems existential.
