One of the many things I do not understand: how using a constitutionally guaranteed right can be punished.

Or more specifically, given I know perfectly well that rules are only as good as their enforcement, how the people who decided to vote this way are getting away with (what looks to me like) breaking their constitution.

They interpreted that Fauci waived his Fifth Amendment right by delivering an opening statement. Also, a witness fully immune from federal prosecution (in this case by having a presidential pardon) cannot claim a risk of self-incrimination to avoid testifying.
