The metric should be safety per se But Tesla lies about its data, and no state wants to have to pay to test every AV directly.

More to the point: Musk is hated, particularly in blue states and in Europe. That means kiboshing Tesla is simply good politics. (Given Musk promoted this brand of retributive politics, there is justice in it, too.)
